DipYourCar Installer Details and Disclaimer

DipYourCar operates a platform that provides resources for customers seeking services related to DipYourCar products and lists independent installers, including Installer, for the convenience of customers. This disclaimer describes in detail the relationship between DipYourCar and Installers and limits DipYourCar's liability for any actions, services, or interactions between Installer and customers.

 

RELATIONSHIP OF THE PARTIES

  1. Independent Contractor. Installer is an independent contractor and is not an employee, agent, partner, or representative of DipYourCar. Installer has full control over its business operations, including how services are delivered to customers.

 

  1. No Agency. This Agreement does not create an agency relationship, joint venture, or partnership between DipYourCar and Installer. Installer has no authority to bind DipYourCar in any contractual arrangements or representations made to customers or third parties.

 

  1. Installer’s Business Operations. Installer is solely responsible for its staffing, scheduling, customer service, pricing, payments, and operational decisions. All equipment, tools, and materials required for the provision of services shall be the responsibility of the Installer.

 

LISTING ON DIPYOURCAR’S PLATFORM

  1. Listing Rights. DipYourCar may, at its discretion, list Installer on its website as an independent provider of installation services related to DipYourCar products. DipYourCar reserves the right to modify or remove Installer's listing at any time, for any reason, without prior notice.

 

  1. Accuracy of Information. Installer shall provide and maintain accurate and up-to-date information, including business name, contact details, services offered, and pricing. Installer is responsible for promptly notifying DipYourCar of any changes to this information.

 

  1. Right to Remove. DipYourCar may remove Installer’s listing if Installer fails to maintain required insurance, licenses, or consistently receives negative customer feedback. DipYourCar has the sole discretion to determine Installer’s continued inclusion on the platform.

 

DISCLAIMER OF LIABILITY

  1. No Warranty or Guarantee. DipYourCar does not provide any warranties, express or implied, regarding Installer’s services or the results of such services. DipYourCar does not endorse or guarantee the quality, legality, or performance of any services provided by Installer.

 

  1. No Liability for Installer’s Actions. DipYourCar is not liable for any acts, omissions, or services provided by Installer, including but not limited to defective work, property damage, bodily injury, delays, or any other incidents arising from the Installer’s relationship with customers.

 

  1. Customer Relationship. All agreements, payments, and service-related interactions between Installer and customers are solely the responsibility of Installer. DipYourCar is not involved in nor responsible for any disputes, collections, or claims related to the services performed.

 

INDEMNIFICATION

Installer Indemnification. Installer agrees to indemnify, defend, and hold harmless DipYourCar, its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, liabilities, costs, expenses, and legal fees arising out of:

(a) Installer’s performance or non-performance of services;

(b) Breach of this Agreement;

(c) Any act or omission of Installer, including misrepresentations or violations of applicable laws;

(d) Any customer disputes, claims, or actions related to the services performed by Installer;

(e) Property damage, bodily injury, or any violations of consumer rights.

 

Survival of Indemnification Obligations. The obligations under this section shall survive the termination of this Agreement and shall apply even after Installer’s listing has been removed from DipYourCar’s platform.

 

SERVICE STANDARDS AND PERFORMANCE

  1. Workmanship Standards. Installer agrees to perform services in a professional, workmanlike manner in accordance with industry standards and all applicable laws. Installer shall use reasonable care and skill in performing services for customers.

 

  1. Customer Complaints. Installer is solely responsible for handling customer complaints related to its services. Installer agrees to respond promptly to customer complaints and make good-faith efforts to resolve disputes to the customer’s satisfaction.

 

  1. Compliance with Laws. Installer agrees to comply with all applicable laws, regulations, and industry standards while providing services to customers, including labor laws, environmental regulations, and consumer protection statutes.

 

LIMITATION OF LIABILITY

  1. Limitation of Damages. DipYourCar shall not be liable to Installer for any indirect, incidental, consequential, or punitive damages, including lost profits, loss of business opportunities, or reputational harm, arising out of or related to this Agreement.
